Terms and Conditions
Welcome to our “Stroke Smart” mobile application. The Stroke Smart App is wholly owned and managed by the University of Hong Kong. We provide the mobile application services to you subject to these terms and conditions of use (the “Terms of Use”). By accessing or otherwise downloading, installing or using our mobile application, you acknowledge that you have read and understood the Terms of Use and agree to be bound by them.
If you do not agree to these Terms of Use, you should immediately cease downloading, installing or using the Stroke Smart App.
The Stroke Research Group of the University of Hong Kong (HKU Stroke) reserves the right to change these Terms of Use at any time by updating the Stroke Smart App to incorporate new terms of use, without prior notice. You are responsible for regularly reviewing the information we publish online so that you remain informed of such changes in a timely manner. Your continued use of the Stroke Smart App constitutes your acceptance of the revised Terms of Use.
By downloading, installing, accessing or using the Stroke Smart App, you represent (and we are entitled to rely on such representation) that you are 18 years of age or above and have the capacity to enter into a legally binding contract.
Definitions
“We” refers to the person or company providing the services, and primarily refers to The Stroke Research Group of the University of Hong Kong (HKU Stroke).
“You” refers to the end user or individual to whom we provide the services.
Prohibited Conduct
You must not access or use, or attempt to access or use, the services provided via the Stroke Smart App for any purpose that may harm us or any third party, interfere with the operation of the services, or use the services in any manner that violates any applicable law.
For example (without limitation), you must not:
i. transmit any message or material under a false name, or otherwise misrepresent your association with, or the origin of, any material you transmit;
ii. provide information that is untrue, inaccurate, not current or incomplete;
iii. transmit any message or material that is illegal, injurious, defamatory, obscene, fraudulent, exploitative of minors, harassing, threatening or hateful in nature;
iv. transmit any message or material that infringes or violates the intellectual property rights (including but not limited to copyright, trademark rights and broadcasting rights), privacy rights or publicity rights of others;
v. copy, forward, distribute, disseminate, sell, publish, broadcast or transmit to any person any content obtained through the services provided via the Stroke Smart App without prior express permission;
vi. use any device, software or routine to interfere or attempt to interfere with the proper operation of the services provided via the Stroke Smart App;
vii. attempt to modify, translate, decipher, decompile, disassemble, reverse engineer or create derivative works from any software that forms, or in any way constitutes, any part of the services; or
viii. engage in any other conduct that restricts or inhibits any person from using or enjoying the services, or that, in our sole discretion, may expose us or any of our users, affiliates or any other third party to any legal liability, damages or any kind of adverse impact.
We reserve the right, at any time and for any reason or no reason, to suspend or terminate your right to use the services provided via the Stroke Smart App, without prior notice.
Intellectual Property
The services provided via the Stroke Smart App are protected by the copyright laws of the Hong Kong Special Administrative Region (“Hong Kong”). To the maximum extent permitted under Hong Kong copyright laws, all copyrights relating to the services provided via the Stroke Smart App are owned by us or our third-party licensors. Without our express written consent, you may not publish, copy, distribute, display, perform, edit, adapt, modify or otherwise exploit any part of the services.
Nothing in the services provided via the Stroke Smart App shall be construed, whether expressly or impliedly, as granting you any licence or right under any copyright laws of Hong Kong.
Disclaimer
The information you obtain or receive from the services provided via the Stroke Smart App is for reference only. The information provided by the mobile application is not intended to replace and cannot replace professional medical advice, diagnosis or treatment. Do not disregard, avoid or delay obtaining medical advice from a qualified doctor or healthcare professional because of something you may have learned or read in the mobile application. Do not use the mobile application to handle emergency medical needs.
You use the services provided via the Stroke Smart App at your own risk. Any content described or contained in the mobile application, or provided through any services, is not intended to and must not be regarded as the practice of medicine or the provision of medical care services. You bear all risks arising from your reliance on any information provided through the Stroke Smart App. The Stroke Smart App services are provided on an “as is” basis, without any warranties of any kind, express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose, non‑infringement or non‑violation of other rights. We make no guarantee as to the suitability, timeliness, accuracy, likely results or completeness of the services, or of any third‑party websites linked to or from the services provided via the Stroke Smart App, nor do we guarantee that the functions provided will be uninterrupted, virus‑free or error‑free. We expressly disclaim any responsibility for any errors or omissions in the content contained in the services, or in any third‑party websites linked to or from the services.
Use of information provided by or through the use of the Stroke Smart App does not create a doctor–patient relationship. We make no express or implied warranties, representations or guarantees regarding any professional qualifications, expertise, quality of work, or other information.
Limitation of Liability
Under no circumstances shall Stroke Smart be liable for any special, punitive, consequential, incidental, direct or indirect damages (including but not limited to damage to person or property, loss of profits, interruption of personal and/or business activities, loss of personal and/or business information, or any other financial loss) arising out of or in connection with your use of, or inability to use, the Stroke Smart App, even if Stroke Smart has been advised of the possibility of such damages.
Indemnity
You agree to indemnify and hold harmless Stroke Smart and any of its subsidiaries, affiliates, trustees, directors, officers, employees, researchers and agents from and against any and all claims, demands, losses, damages, penalties, costs or expenses of any kind arising out of or in connection with your use of, or inability to use, the Stroke Smart App. We reserve the exclusive right to defend and control any claim, demand or action arising under these Terms of Use or in connection with the Stroke Smart App, including all negotiations for settlement or compromise. You agree to fully cooperate with us, upon our request, in the defence of any such claim, demand, action, settlement or compromise negotiation.
Linked Websites
Certain links (including hyperlinks) in our application will take you out of our application. These links are provided solely for your convenience and do not constitute or imply our endorsement or approval of the linked sites, their operators, or their content. We are not responsible for the content of any websites outside our application.
Copyright and User Responsibilities
All content provided in this application, including but not limited to any images, photographs, animations, videos, audio, music, text and applets contained in the Stroke Smart App, as well as printed materials within the Stroke Smart App, are the property of Stroke Smart. Without the written permission of Stroke Smart, the content of this application may not be modified, used, copied or accessed for any purpose and in any form. The data in this mobile application may not be sold or used for profit‑making purposes of any kind.
Third‑Party Mobile Applications
The application may contain third‑party information or links to other applications. Stroke Smart is not responsible for the operation or content of any third‑party data that is not directly controlled by Stroke Smart. The links displayed in the application are for reference only. Your access to any third‑party application is entirely at your own risk, and Stroke Smart accepts no responsibility for any information contained in, or any use of or reliance on, any third‑party application.
User Privacy
Unless otherwise specified, all personal data provided when using this application will be handled in accordance with the Privacy Policy Statement and applicable laws of Hong Kong. You are fully responsible for the information you provide when using the application, and you agree to provide us with accurate and up‑to‑date information. Stroke Smart will take all reasonable steps, in strict compliance with Hong Kong law, to keep any personal information in this mobile application confidential. For further details on privacy, please refer to the Privacy Policy Statement.
Entire Agreement
These Terms of Use constitute the entire agreement between you and Stroke Smart regarding the Stroke Smart App and any support services (if any), and supersede all prior oral or written communications, representations or understandings relating to the Stroke Smart App or any subject matter covered by these Terms of Use.
In the event of any conflict between these Terms of Use and any terms in the policies or procedures of the Stroke Smart App support services, these Terms of Use shall prevail.
Third‑Party Rights
The parties hereby declare that nothing in this agreement shall confer, or be intended to confer, any benefit or any right on any third party to enforce any term of this agreement under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) or any other foreign legislation having similar effect.
Governing Law
These Terms of Use are governed by and shall be construed in accordance with the laws of the Hong Kong Special Administrative Region (“HKSAR”). For any claim or dispute arising out of or in connection with the services provided via the Stroke Smart App that is brought against us, you agree to submit to the exclusive jurisdiction of the Hong Kong courts.
Miscellaneous
If any provision of these Terms is found to be unenforceable, the validity or enforceability of the remaining provisions shall not be affected.
You agree that nothing in these Terms or in your use of the services provided via the Stroke Smart App shall be deemed to create any joint venture, partnership, employment or agency relationship between you and us.
Our failure to enforce any provision of these Terms shall not be construed as a waiver of our right to enforce any terms or conditions of these Terms at any later time.
